In consideration of enrolling your Student (the “Student”) in the online 2021 Summer Learning Program at St. George’s School (the “School”) the Student’s parent(s), guardian(s) and/or other financially responsible individual(s) jointly and individually, and intending to be legally bound, understand and agree to all of the following terms and conditions, including the obligation to pay the full tuition amount due. I, on my own behalf and on behalf of the Student, agree as detailed below.

Enrollment/Registration Contract
Term. This Enrollment/Registration Contract (the “Contract”) is for the 2021 online summer program only. The 2021 online sessions take place between June 14 and July 30.
Required Course Minimum Enrollment: A minimum of 5 students is required in order for a session to begin. If that minimum is not reached, the Student will be notified that the session will be canceled and the tuition and any technology fee will be refunded.
Tuition and Fees.
• Current or Matriculating School Student: I agree to pay the tuition, based on the number of course credits selected, less any financial aid, and I understand that this Contract is not a fractional contract and that I am responsible for the full payment of the tuition according to the terms of this Contract.
• Summer Guest Student: I agree to pay the tuition, based on the number of course credits selected, and a nonrefundable technology fee of $200. I understand that this Contract is not a fractional contract and that I am responsible for the full payment of the tuition and technology fee according to the terms of this Contract.
Payment. Payment in full is due at the time of registration. If the School receives notification from me in writing by May 1, 2021, stating that the Student will not attend the online summer session, an 85% refund will be available. Any notification of withdrawal received after May 1, 2021 and before the day the class begins is eligible for a refund of 75% of the tuition paid. No refunds will be made to any Student who withdraws on or after the first day of class. If the Required Course Minimum Enrollment is not met, a 100% refund (including any technology fee paid) will be available and this Contract shall be canceled. No portion of such tuition, either paid or due, will be refunded or canceled, regardless of absence, separation, withdrawal, or dismissal of the Student from the session or the School once these particular timelines have passed.
Consequences of Late/Non-Payment. I understand that all tuition and any applicable fee are due at the time of registration. I acknowledge and agree that timely payment of the tuition and applicable fee is a condition of enrollment and that default on the timely payment of the tuition may result in certain actions being taken by the School, including, but not limited to, the School’s refusal to permit the Student to participate in the session or take assessments, to the extent permissible under applicable law. In addition to all unpaid amounts, I shall pay all costs of collection, including all attorneys’ fees and costs. The School reserves the right to refuse enrollment of the Student unless all outstanding payment obligations are met or satisfactory arrangements for payment are made with the School’s Finance Office.
The Shield. For Current School Students only: I understand that I have the responsibility to become familiar with and abide by the School’s policies, rules, regulations, procedures and standards of academic and social behavior as set forth in The Shield: Community Handbook of St. George’s School (“The Shield”) and to review its contents with the Student. I understand that The Shield sets forth general expectations regarding the Student’s enrollment at the School, but it does not constitute a contract between the School and me or the Student. I understand that the School may deviate from the guidelines and expectations set forth in The Shield in its discretion as individual circumstances may warrant. In the event of a conflict between the terms of this Contract and any handbook provided by the School, the terms of this Contract shall govern.
Expectations. The Student and I agree to comply with and be subject to the School’s policies, rules, and standards of academic and social behavior as outlined within this contract, the Honor Code and the Summer Electronic Communications and Acceptable Use Policy which is available on the Schools website at www.stgeorges.edu/academics/summer/about/expectations. The School believes that a positive and constructive working relationship among the School, the Student and the Student’s parents or guardians is essential to fulfillment of the School’s educational mission. The School requires parents to cooperate in the Student’s best interests with respect to the Student’s education, including avoiding being disruptive to the Student’s education. I agree to keep the School informed of any and all living and custody arrangements and any changes to those arrangements that may affect the Student’s educational experience at the School. In addition, if the School determines that the Student, or a family member or other individual associated with the Student, has engaged in any behavior prior to, or during the Summer Learning term that, in the School’s discretion and judgment, makes such a positive and constructive relationship difficult or impossible or otherwise interferes with the School’s ability to fulfill its educational purposes or runs contrary to the best interests of the School or members of the School community, the School reserves the right, in its discretion and without limitation, to cancel the Student's enrollment.
Limits of Confidentiality. I understand that the School must balance the confidentiality of the Student’s medical and mental health information with the need to safeguard the well-being of the Student and the St. George’s Community and I therefore permit the Director of Health Services, the Director of Counseling or their designees, to disclose to authorized employees and agents of the School, who have a need to know, the minimum amount of medical and/or psychological information necessary to protect the health, safety, or welfare of the Student and/or the Community.
Student Email, Calendar and Other Google Products. The School uses G Suite for Education tools and applications including email, calendars, file storage and web browsing to aid students in completing assignments and communicating with the School Community. G Suite K-12 complies with Federal privacy standards relating to children. I have had the opportunity to review the G Suite for Education Privacy Notice which is available on the School’s website at www.stgeorges.edu/families/technology. I understand that I am permitting the Student to use G Suite for Education applications and tools once those products are available to the Student.
Force Majeure. I understand that the duties and obligations of the School under this Contract may be suspended immediately without notice during all periods that the School is closed because of events beyond the School’s control (force majeure), including, but not limited to, fire, acts of God, war, governmental action, terrorism, communicable disease, weather, other threats to the safety of students, national emergencies, and any other event beyond the School’s control. If such an event occurs, the School’s duties and obligations under this Contract may be modified, suspended or postponed until such time as the School, in its sole discretion, may safely re-open. By signing below, I acknowledge and agree that the sole financial remedy for a force majeure event is future service delivery and not a tuition refund.
Governing Law; Disputes. This Contract shall be interpreted in accordance with the laws of the State of Rhode Island. In the event of any dispute arising out of this Contract or otherwise between the School and me, my spouse/partner/guardian/financially responsible person or the Student, the parties must mediate such dispute in good faith before commencing any other legal proceeding. If mediation is unsuccessful, the dispute shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction. The venue for all mediation and arbitration proceedings shall be within the State of Rhode Island.
Severability. If any part of this Contract is found to be unenforceable or illegal by a court of competent jurisdiction, the remainder of this Contract shall not be affected thereby, and each portion and provision of this Contract shall be valid and enforceable to the fullest extent permitted by law.
Entire Agreement. This Contract is the entire agreement of the parties relating to the Student’s enrollment at the School, and I acknowledge that I am not relying on any other oral or written agreements. This Contract may not be amended except in a written document signed by all parties that expressly acknowledges such amendment.
Counterparts. This Contract may be executed in counterparts, all of which shall constitute one and the same agreement.
I understand and agree that this Contract is a binding and enforceable legal obligation and that the School may bring a civil action to enforce the obligation.
If the Student to whom this Contract pertains is 18 years of age or older, the Student is required to indicate agreement to the terms of this Contract by signing a version of this contract that will be emailed to the Student by the Finance Office. If the Student is younger than 18 years of age, please be advised that the Student will be required to sign a document containing language similar to the language below, in connection with the Student’s 18th birthday.
By signing this contract, the Student who is 18 years of age or older gives permission to the School to discuss and release information and records to the Student’s parents and legal guardians about any issues relating to the Student’s enrollment at the School, including, but not limited to, academic records, academic performance, health matters, disciplinary issues, and financial matters. By signing below, the Student acknowledges that the Student understands and agrees that this Contract supersedes all applicable laws that might otherwise restrict the School from sharing such information, and thus the School is authorized to interact with the Student’s parents and legal guardians as if the Student were under the age of 18.
By indicating on the Registration Form that I have read this contract and understand and accept all of its terms and conditions, I also acknowledge that I am agreeing to this Contract as the parent/guardian or the person financially responsible for the Student’s finances. I acknowledge and agree that my acknowledgement on the Registration Form has the same legal effect and validity as my written signature, and that this Contract is valid and will be given the same legal effect as a written and signed contract. I further acknowledge and agree that no certification authority or other third party verification is necessary to validate my acknowledgement on the Registration Form, and that the lack of such certification or third party verification will not in any way affect the enforceability of my acknowledgement or this binding Contract between the School and me. My consent to this acknowledgement applies only to this Contract and does not apply to any separate transactions or communications with the School. If I do not want to enter into this Contract by providing my acknowledgement on the Registration Form, I understand that I have the right to perform this transaction in non-electronic form by contacting the Finance Office at 401-842-6782.
